Program Contest

OFFICIAL CONTEST RULES AND REGULATIONS 

The Bank of Nova Scotia (“Scotiabank” or the “Sponsor”) will be relaunching the Scotiabank Hockey Club Loyalty Program (the “Program”) on September 25th, 2017. By registering for the Program, fans will be eligible for exclusive members’ benefits and the opportunity to win a variety of amazing prizes (outlined in Section 11). By registering fans will be required to opt-in to the “Scotiabank Hockey Club Loyalty Program Contest” (the “Contest”). The Contest allows members to earn entries in the form of ballots. For complete details regarding Contest entry mechanics please refer to Section 7. The Contest is ongoing and is divided into Contest Periods (each a “Period”). Each Period will vary in duration and will have its own unique set of prizes. At the end of each Period a predetermined number of potential Grand Prize and Secondary Prize winners will be selected via a random draw.

IMPORTANT DATES

1. The first Period starts on September 25th, 2017 at 9 am (ET) and concludes on December 4th, 2017 at 9 am (ET).

3. Scotiabank will contact the selected candidates via the telephone and/or email address provided when registering for the Program (in accordance with Section 9) within three (3) days of the applicable draw date. Once verified, the Winners (as defined below) will be announced via Scotiabank’s social media channels and online at www.scotiahockeyclub.com. For mobile phone users, standard data and message rates may apply.

ELIGIBILITY

4. No purchase is necessary to participate in the Contest.

5. Open only to legal residents of Canada, excluding Quebec, who are sixteen (16) years of age or older prior to the beginning of the applicable Period and who have registered for the Program.

6. The Contest is not open to employees of Scotiabank, the NHL Entities (defined below) or their respective affiliates or advertising or promotional agencies (collectively, the “Indemnified Parties”), or members of their immediate family (spouse, father, mother, brothers, sisters, sons and daughters).

HOW TO ENTER

7. To enter, individuals must first register and become members of the Program. Once they have registered they will be eligible to begin earning ballots for the Contest. Ballots can be earned in several different ways, each of which is outlined below.

Users will be able to view the total amount of ballots they have earned for a given Period on their dashboard by signing in at www.scotiahockeyclub.com. Each ballot will be valid for all prize draws for the applicable Period only. Additional ballot earning actions can be instituted at any time at the discretion of the Sponsor. Any additional actions will be communicated to members on the How to Play page www.scotiabankhockeyclub.com/pages/howtoplay. The odds of winning depend on the number of total ballots submitted during the given Period. At the start of each new Period all members’ ballots will be reset to zero. 

CONTEST PERIODS AND DRAW SCHEDULE

8. On average each Period will last approximately two months. The first Period will commence September 25th, 2017 at 9 am (ET) and concludes on December 4th, 2017 at 9 am (ET). Details regarding the start and end dates for the subsequent Period can be found at www.scotiabankhockeyclub.com/pages/prizes. All Grand Prize and Secondary Prize draws will take place within three (3) days of the given Period’s end date at Scotiabank’s offices located at 100 Yonge St, Toronto, ON M5C 2W1. The number of potential winners selected will vary from Period to Period at the Sponsor’s discretion. The exact number of prizes available for each given Period will be announced at the commencement of that Period at www.scotiahockeyclub.com/pages/prizes

POTENTIAL WINNER NOTIFICATION AND VERIFICATION

9. Each selected candidate will be required to:

  • be reachable via the telephone or email provided upon registration within three (3) business days of the respective Period end date; and respond to Scotiabank or a Scotiabank representative by email or phone within two (2) business days indicating his or her (or if a minor in his/her province of residence, his or her parent’s/legal guardian’s) (i) acceptance of being declared a winner and (ii) agreement with the Declaration and Release Form.
  • answer unaided, a time-limited, mathematical skill-testing question. The selected entrants will be contacted via the telephone or email in which entry was submitted by a representative of the Sponsor to make arrangements for administering the skill-testing question.
  • properly complete, sign, and return a Declaration and Release Form that among other things, gives Scotiabank the consent to use his/her name, image, rendition, likeness, photo and address (city, province and country only), without remuneration, compensation or other obligation for promotional purposes, and releases and indemnifies the Indemnified Parties from all liability connected with the Contest. The completed Declaration and Release forms must be received by the Sponsor’s Office: Scotiabank, 100 Yonge Street, 6th Floor, Toronto, Ontario, M5C 2W or by email to be provided to the potential winner, within two (2) business days following the date that the selected entrant was first contacted by the Sponsor. Grand Prize Winner’s guest will also be required to sign a Liability and Publicity Release.
  • provide Scotiabank with documentation satisfactory to Scotiabank to enable it to verify the candidate’s identity (e.g., copy of government-issued ID).

Arrangements will be made for the awarding of the prize at the time all of the above elements are complied with.

10. The selected candidates that meet the requirements of these Official Contest Rules and Regulations are considered to be the official winners of the Contest for the applicable period and are referred to herein as the “winners” or “winning candidates”. If a selected candidate cannot be reached within the designated timeframe, fails to provide any of the required forms, fails to correctly answer the skill-testing question, or is found to be ineligible for any reason, an alternate winner may be selected and subject to verification in the same manner.

11. Prizing will vary for each Period but will remain consistent with the overall value and examples outlined below (the chart represents the typical prize offering for a single Period).

12. The following conditions apply to the Grand Prize: 

  • Any difference between the approximate retail value and the actual value of the Grand Prize as taken will not be awarded. 

  • The winner and his/her travel guest are responsible for all other costs and expenses not specifically listed above, including, without limitation, all provincial, federal, and local taxes, meals, food, beverages, insurance, valid travel documentation, transfers to and from the airports, car rentals, medical/health expenses, gratuities, excess baggage fees, communication charges, admission fees and all personal expenses and incidentals. The Sponsor and the NHL Entities will not be responsible for risk associated with any travel elements, including without limitation, air travel, and quality of service provided by the airline, hotel staff and management, the trip organizers, or any other service providers. 

  • The Grand Prize must be taken at the time and to the destination stipulated by the Sponsor or will be forfeited. The winner and his/her travel guest must travel on the same itinerary and have valid travel documents (such as a passport) or the Grand Prize will be forfeited. There are no deviations to travel allowed (i.e. length of stay, number of guests, flight stopovers, travel dates, etc.).

  • The Grand Prize must be accepted as awarded without substitution and is not transferable or redeemable for cash or allowed to be sold. No change in travel arrangements can be made once the booking has been confirmed. The Sponsor reserves the right to substitute the Grand Prize in whole or in part in the event that all or any of the components of the Grand Prize are unavailable or otherwise not capable of being awarded.

  • In the event that a winner is unable to redeem any or all of the Grand Prize components due to reasons beyond the control of the Sponsor, its employees, representatives, agents, the NHL Entities, and all other parties associated with this Contest, no compensation or substitute prize will be provided.

  • If any component of a Grand Prize is canceled or postponed for any reason, the awarding of the balance of that Grand Prize will be deemed to be in full satisfaction of the Grand Prize award.

COMPLIANCE WITH THESE OFFICIAL CONTEST RULES AND REGULATIONS

13. By participating in this Contest, candidates agree (or if candidates are minors, their parents/legal guardians agree) to be bound by these Official Contest Rules and Regulations. In the event that any selected candidate does not comply with these Official Contest Rules and Regulations, including the time-sensitive requirements in Section 9, the candidate may be disqualified or ineligible in the Sponsor’s sole discretion. 

PRIVACY 

14. Scotiabank is committed to respecting the privacy of candidates. Any personal information collected will be handled in strict accordance with all applicable privacy legislation. Scotiabank will not sell any personal information collected for this Contest to any third parties. Any personal information collected for this Contest shall be used by Scotiabank solely for the purpose of managing and administering this Contest. By entering this Contest, candidates hereby consent to Scotiabank’s collection, use and disclosure of his/her personal information, including to Scotiabank affiliates and subsidiaries, solely in order to manage and administer this Contest.

LIMITATION OF LIABILITY

15. By making a submission, each candidate (a) releases and holds harmless the Indemnified Parties, Facebook Inc., Twitter, Inc., their subsidiaries and affiliates and their respective officers, directors, employees, representatives, assigns, advertising and other agents from any and all claims, actions, causes of action, complaints, demands, penalties, costs, expenses and fees or whatever kind arising now or in the future which he/she has or may have arising out of or in any way related to the Contest and/or his/her acceptance, use or misuse of the prize; and (b) agrees to fully indemnify the Indemnified Parties, Facebook Inc., Twitter, Inc., judges, their subsidiaries and affiliates and their respective officers, directors, employees, representatives, assigns, advertising and other agents from any and all claims by third parties without limitations.

NO RESPONSIBILITY FOR ERRORS

16. Scotiabank assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Scotiabank is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or for any lost, late, or misdirected entries or on account of any combination of the foregoing.

17. Scotiabank is not responsible for any injury or damage to entrants or to any computer related to or resulting from participating or downloading materials associated with this Contest. 

RIGHT TO MODIFY / TERMINATE AWARD

18. Scotiabank may terminate, modify or suspend the Contest for any reason with a minimum of thirty (30) days’ notice at any time. Such notice will be posted on the prizing page www.scotiahockeyclub.com/pages/prizes. Scotiabank also reserves the right to terminate, modify or suspend the Contest without prior notice. If, for any reason, the Contest is not capable of running as planned, including but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, acts or omissions of any stock exchange, riots, wars or terrorism, strikes or other labour disputes, natural disasters or any other causes beyond the control of Scotiabank, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest.

DECISIONS FINAL

19. Decisions of the Sponsor are final and binding with respect to all aspects of this Contest. All entrants consent to the jurisdiction and venue of the Province of Ontario. 

SUBJECT TO APPLICABLE LAW

20. The Contest is subject to all applicable laws, rules and regulations.

GENERAL TERMS AND CONDITIONS 

22. Any person who enters or tries to enter the Contest in a manner which is unfair to the other entrants will be automatically disqualified and could be referred to the appropriate authorities.

The use of automated software or computer programs to register or enter this Contest is prohibited and any individual who uses or attempts to use such methods to register or enter will be disqualified. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.In the event it is determined that an entrant has entered in a fashion not sanctioned by these Official Contest Rules and Regulations, has made a misrepresentation, or has submitted more than the number of entries permitted by these Official Contest Rules and Regulations, the entrant will be disqualified. The use of an invalid email address will disqualify the entry. Users spamming the same email address will disqualify the entry.

By entering this Contest, entrants (or if minors, parents/legal guardians of entrants) release the Sponsor, the NHL Entities, Bond Brand Loyalty, their subsidiaries, affiliated companies, advertising and promotional agencies, employees, representatives and agents from any and all liability for damages of whatever nature that arise from the acceptance, use or misuse of all or any part of a prize, including any travel related thereto, or otherwise from participation in this Contest.

The “NHL Entities” means the National Hockey League (“NHL”), its member teams, NHL Enterprises Canada, L.P., 

NHL Enterprises, L.P., NHL Enterprises B.V. and NHL Interactive CyberEnterprises, LLC. 

The Sponsor reserves the right to correct clerical or typographical errors in promotional materials or these Official Contest Rules and Regulations. 

If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address or social media account provided at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. 

By accepting a prize, winners consent to the use of their name, personal information (city and Province of residence) and likeness for advertising and promotional purposes related to this Contest by the Sponsor without further notice or compensation. 

The Sponsor shall not be responsible for any failure of email or social media account during the Contest or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email, on-line, or Internet entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible for technical problems, traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer or property related to or resulting from playing or downloading any material on the Contest website. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. 

This Contest is subject to all applicable federal, provincial and municipal laws. 

This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, or Twitter.
